FDA Ban on Flavored Cigarette Tobacco and Cigarette Papers.

The FDA released a new opinion stating that they believe flavored cigarette rolling papers and filters are subject to the Family Smoking Prevention and Tobacco Control Act’s (“FSPTCA”) ban on RYO tobacco and cigarettes with characterizing flavors that took effect on September 22, 2009. The FDA was given authority to regulate tobacco products which were loosely defined as products made of or containing tobacco. Separately sold cigarette rolling papers, tubes and filters do not meet that definition in our opinion. However the FDA is a very large organization with impressive powers – therefore we will err on the side of caution and discontinue selling flavored cigarette papers until we are able to get a favorable opinion from the FDA or a court of law to issue a declaratory judgment or similar ruling against them. This means no more flavored rolling papers like Juicy Jays, Brown Sugar and Golden Wrap. All Cyclone clear cones and tobacco leaves (blunts) are AOK. Cigarette, pipe, cigar, and smokeless tobacco are all different. The new law against flavored tobacco, etc... Is only for flavored cigarette tobacco, flavored cigarette filters and flavored cigarette paper. Menthol is not affected by this either.
